Terms of service
Last Updated: October 22, 2026
1. Introduction and Company Details
These Terms of Service ("Terms") govern your use of the website humanmatter.com (the "Website") and all purchases of products made through it. In these Terms, "Human Matter," "we," "us" and "our" refer to the operator of the Website and seller of record, and "you" refers to anyone who visits the Website or buys from us.
The Website is operated by Human Matter Labs LLC, a limited liability company organized under the laws of the State of Wyoming, United States (Filing ID 2026-002111477), with its principal address at 1309 Coffeen Avenue STE 1200, Sheridan, Wyoming 82801, USA. Human Matter Labs LLC is the contracting party for all sales made through the Website. You can reach us at hello@humanmatter.com.
We sell to customers in the United States, the United Kingdom, the European Union and the other countries available at checkout.
By using the Website or placing an order, you agree to these Terms and to the policies they incorporate by reference: our Shipping Policy, our Refund & Returns Policy and our Privacy Policy. If you do not agree, please do not use the Website or place an order.
You confirm that you are at least 18 years old, or the age of legal majority where you live, and able to enter into a binding contract.
2. Scope of Terms and Acceptance
These Terms apply to all purchases, browsing and communications through the Website. The policies referred to in Section 1 form part of the agreement between you and Human Matter. Where a policy deals with a specific point of shipping or refunds in more detail, that policy applies to that point.
3. Product Information and Pricing
We work to make sure that product descriptions, ingredient lists, images and prices on the Website are accurate and up to date. Packaging and appearance may vary slightly as we improve our products, or because of your screen settings.
Prices are shown in US dollars (USD) unless a different currency is shown at checkout. All duties and import fees are included in your price. You pay nothing on delivery. Standard shipping is free on every order.
We may correct pricing errors or typographical mistakes at any time. If an error materially affects an order you have already placed, we will contact you and let you choose to proceed at the correct price or cancel the order for a full refund.
4. Health Information
FemSwitch is a dietary supplement. It is not a medicine and is not a substitute for advice, diagnosis or treatment from a qualified healthcare professional. The information on the Website, in our emails and on our social media channels is provided for general information only and does not constitute medical advice.
FemSwitch is not intended for use if you are pregnant, trying to conceive or breastfeeding, or by anyone under 18. Please talk to your doctor before using FemSwitch if you take any medication or have a medical condition. Use the product only as directed on the label. Stop using it and seek medical advice if you experience an adverse reaction.
Individual experiences vary. That is why FemSwitch is backed by our 90-Day Guarantee.
These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.
5. Orders and Contract Formation
When you place an order, you agree that the information you provide is true, accurate and complete. An order is a one-time purchase unless you choose Subscribe & Save (see section 9).
Submitting an order is an offer to buy. A binding contract is formed when we send you an order confirmation email. We may still decline or cancel an order before it ships for lawful reasons, including suspected fraud, a pricing error, a payment problem or a breach of these Terms. If we do, we will notify you and refund any payment in full to your original payment method.
We may limit quantities or refuse service where reasonably necessary to prevent fraud, comply with the law or stop abuse of our offers or our guarantee.
6. Payment and Billing
We accept the payment methods shown at checkout. Payments are processed by secure, PCI-compliant payment providers, and we do not store your full card details. By submitting payment information, you confirm that you are authorized to use the payment method, and you authorize us and our payment providers to charge the full order amount, including any applicable taxes, to it.
Your payment method is charged once, for the order you place. Billing information must be true and accurate. Prices may change from time to time, but a change never affects an order we have already confirmed.
7. Shipping and Delivery
Shipping is governed by our Shipping Policy, which is incorporated into these Terms by reference. In summary: standard shipping is free on every order, orders are prepared and shipped within 1–3 business days, and the risk of loss stays with Human Matter Labs LLC until your order is delivered to you.
8. Returns, Refunds and Withdrawal
Refunds, returns and statutory withdrawal rights are governed by our Refund & Returns Policy, which is incorporated into these Terms by reference. In summary: we give you three full cycles to feel FemSwitch work, or to see it in your skin; if you don't, email us within 90 days of your first order and we refund every dollar, even on an empty pouch, with nothing to send back. Consumers in the EU and UK keep their statutory 14-day right of withdrawal, and damaged, incorrect or lost orders are replaced or refunded at no cost to you.
9. Subscriptions and Recurring Payments
FemSwitch is available as a one-time purchase or as Subscribe & Save. A Subscribe & Save order is a recurring order: we ship the same pack at the same price on the schedule you chose (2 pouches every 4 weeks, 4 pouches every 8 weeks or 6 pouches every 12 weeks) and charge your payment method on each billing date until you cancel.
You can skip a delivery, pause, change your schedule or cancel at any time in your account (Manage subscription) or by emailing hello@humanmatter.com, with no fees, no minimum number of orders and no phone call. Changes made before your next billing date apply to that order. The full terms are in our Subscription Policy, which forms part of these Terms.
10. Product Quality, Warranties and Legal Rights
We stand behind our products. You are entitled to receive products that match their description, are of satisfactory quality and are fit for their intended purpose.
Statutory guarantees (EU and UK). If you are a consumer in the EU or UK, products bought from us come with the legal guarantee of conformity under applicable consumer law. If a product is defective or not as described, you may be entitled to repair, replacement, a price reduction or a refund. In the EU, this legal guarantee generally lasts at least two years from delivery. UK consumers also have rights under the Consumer Rights Act 2015. Nothing in our policies excludes or limits these rights.
Implied warranties (US). For US consumers, our products may carry implied warranties under applicable state law, including the implied warranties of merchantability and fitness for a particular purpose. We do not disclaim implied warranties where the law prohibits it.
Our commercial guarantees. FemSwitch is backed by our 90-Day Guarantee. Full terms are in our Refund & Returns Policy. These guarantees are in addition to your statutory rights.
How to get help. If you believe a product is defective, damaged or not as described, email hello@humanmatter.com with your order number and a description of the issue. Where a problem is confirmed, we will provide an appropriate remedy without unnecessary delay.
11. Limitation of Liability
No unlawful exclusions. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under non-waivable consumer protection laws. For EU and UK consumers, we do not exclude liability for supplying products that do not conform to the contract.
Indirect damages. Subject to the paragraph above, Human Matter Labs LLC is not liable for any indirect, incidental, consequential, special, exemplary or punitive damages arising out of or related to the Website or our products, including loss of profits, business interruption or loss of data, even if we were advised of the possibility of such damages. Our products are intended for personal use, and we are not liable for losses arising from commercial or resale use.
Liability cap. Except where the law does not allow it, our total liability for any claim relating to a product or the Website will not exceed the amount you paid for the product giving rise to the claim.
Consumer rights. These limitations apply only to the maximum extent permitted by law and do not restrict any mandatory statutory remedy available to you.
Force majeure. We are not responsible for any failure or delay in performing our obligations caused by events beyond our reasonable control, such as natural disasters, severe weather, war, governmental action, pandemics, supply chain or transport disruptions, or internet and utility outages. This does not affect your right to a refund for goods we are ultimately unable to deliver.
12. Governing Law and Disputes
Governing law. These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law principles. If you live outside the United States, you keep the protection of the mandatory consumer laws of your country of residence. In particular, if you are a consumer in the EU or UK, any mandatory provisions of the law of your country that give you greater protection continue to apply. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Contact us first. If you have a concern, please email hello@humanmatter.com first. Most issues can be resolved quickly and informally, and we will work in good faith to do so.
Arbitration. Except where prohibited by applicable law, any dispute, claim or controversy arising out of or relating to these Terms, the Website or our products will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will take place in Sheridan, Wyoming, unless mandatory consumer protection law requires otherwise or the parties agree on another location.
Class action waiver. To the fullest extent permitted by law, arbitration will proceed only on an individual basis. Neither you nor we may bring or take part in any class action, collective action, representative proceeding or consolidated arbitration relating to claims covered by this arbitration provision. The arbitrator may award relief only to the individual party seeking it, and only to the extent needed to resolve that party's individual claim.
Exceptions to arbitration. Nothing in this arbitration provision prevents either party from seeking temporary injunctive relief, bringing a qualifying claim in small claims court, or exercising statutory rights that cannot lawfully be waived. Consumers who live in jurisdictions that grant mandatory local dispute resolution rights keep those rights to the extent the law requires.
Alternative dispute resolution (EU and UK). We are open to informal dispute resolution or mediation with consumers in the EU and UK. We are not currently obliged to take part in a specific alternative dispute resolution scheme, but we will consider requests case by case.
13. User Conduct and Site Use
You agree to use the Website only for lawful purposes, such as browsing products, placing orders and contacting us. You must not introduce malicious code, attempt unauthorized access, interfere with the Website's operation, commit fraud, scrape or extract data without our permission, or violate any law or third-party right.
All content on the Website, including text, graphics, images and logos, is owned by or licensed to Human Matter Labs LLC and may not be copied or reused without our written permission.
Any comments, photos or other content you send us or post on the Website must be lawful, accurate and not misleading, and must not infringe anyone's rights. We may remove or decline content that does not meet these standards.
14. Accessibility and Language
These Terms and our contract with you are in English. If we provide a translation for convenience, the English version controls in case of any inconsistency, to the extent permitted by law.
We want the Website and our policies to be accessible and easy to understand for everyone, including people with disabilities, and we work toward applicable accessibility standards, including the Americans with Disabilities Act (ADA). If you have difficulty accessing any part of the Website, placing an order or reading our policies, email hello@humanmatter.com and we will make reasonable efforts to help or to provide an accessible alternative.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our products, operations or legal obligations. When we do, we will post the revised Terms on this page with a new "Last Updated" date. The Terms in effect when you place an order apply to that order. Your continued use of the Website after an update means you accept the revised Terms. No update will reduce your mandatory consumer rights.
